• inspect areas where containers were stored at least weekly. Also, no inspection records were kept;
•  have a permit for the storage of hazardous waste for over 90 days at the site;
• keep lamps in closed containers or packages;
• label or mark containers of universal waste lamps with one of the following phrases: “Universal Waste-Lamp(s),” or “Waste Lamps,” or “Used Lamps”;
• mark or label with the earliest date that any universal waste in the container became a waste or was received;
• label or mark one container of used oil with the words “Used Oil.”;
• comply the RCRA Post Closure Permit. This includes Part I (F)(6) of the permit;
• maintain the semi-annual groundwater monitoring report. Part I (F)(8) of the permit;

• provide annual training for employees involved with groundwater sampling or the remedial action equipment; and
• review and immediately amend the remediation system’s contingency plan and facility’s contingency plan did not reflect a change in the emergency coordinator;
• provide annual training for employees involved with management of hazardous waste; and
• provide the necessary items needed to demonstrate it could pass the financial test mechanism nor provide alternate financial assurance for post-closure care.

Failed to:

• keep closed and mark with the accumulation start date and the words “Hazardous waste”;

• place hazardous waste in containers, keep containers closed and mark with the words "Hazardous Waste";

• have any spill control material at the facility;

• have the location of the spill control material by a telephone and keep available on site;

• have signed copies of all manifests; and

• hazardous waste was disposed of improperly on-site.

• have any spill control equipment at the facility and to post the location of spill control equipment next to a phone;

•  respond to releases of used oil to the environment, and the facility continues to release used oil to the environment by not containing or cleaning up spills.
