REC VIOLATIONS

Violations and sanctions/penalties assessed against RECs and RSMs (Registered Site Managers acting on behalf of the RECs) are listed below.

MACTEC Engineering and Consulting, Inc. 2/19/2007 REC fined $10,625.00
  • RSM/REC did not evaluate all remedial goals.
     
  • RSM/REC did not complete remedial investigations.
     
  • RSM/REC did not prepare and certify remedial investigation work plans prior to implementation of remedial investigations.
     
  • RSM/REC did not submit properly certified documents (remedial investigation work plan).
     
  • RSM/REC submitted remedial investigation work plans that did not contain the components of a remedial investigation plan as required by 15A NCAC 13C .0306(g).
     
  • RSM/REC submitted remedial investigation reports that did not contain the components of a remedial investigation report as required by 15A NCAC 13C .0306(h).
     
  • RSM/REC submitted remedial action plans that did not contain the components of a remedial action plan as required by 15A NCAC 13C .0306(l).
     
  • RSM/REC failied to submit a certified work phase completion statement upon completion of the remedial investigation.
Clark Environmental Consultants, P.C. 12/2/2005 REC fined $8,750.00
  • RSM/REC did not notify the Division that contamination had migrated off the source property onto adjoining property within 24 hours of discovery.
     
  • RSM/REC did not submit remedial investigation work plans prior to implementation of assessment work.
     
  • RSM/REC did not submit properly certified documents (remedial investigation work plans, remedial investigation reports, and remedial action plans).
     
  • RSM/REC submitted a remedial investigation work plan that was insufficient in scope and did not contain all of the components of a remedial investigation work plan as required by 15A NCAC 13C .0306(g).
     
  • RSM/REC failed to provide waste disposal and well installation permit documentation.
     
  • RSM/REC failied to submit a certified work phase completion statement upon completion of the remedial investigation.
     
  • RSM/REC submitted a remedial action plan that did not contain all of the components of a remedial action plan as required by 15A NCAC 13C .0306(l).

 

S&ME, Inc. 06/11/03 REC fined $16,875.00; RSM disqualified from the REC Program
  • RSM/REC performed remedial actions without a certified and submitted remedial action plan.
  • RSM/REC failed to properly maintain the public record for the site.
  • RSM/REC did not submit a remedial investigation work plan prior to implementation.
  • RSM/REC submitted a remedial investigation work plan that was not certified, was not submitted within 30 days of completion, was insufficient in scope and did not contain all of the components of a remedial investigation work plan as required by 15A NCAC 13C .0306(g).
  • RSM/REC did not define the full extent of soil contamination.
  • RSM/REC did not complete the remedial investigation within three years of the effective date of the voluntary cleanup agreement.
  • RSM/REC did not perform adequate waste characterization following excavation.
  • RSM/REC did not include appropriate certifications with two submitted documents.
  • RSM/REC did not provide all required components of the remedial investigation report as required by 15A NCAC 13C .0306(h).
     
  • RSM/REC failed to comply with Department’s request for waste disposal manifests.

 

Mid-Atlantic Associates 09/04/02 Disqualified from REC Program for 9 months
  • REC did not complete remedial investigations at three sites within three years of the effective dates of the voluntary cleanup agreements.

  • REC performed phases of remedial investigations without work plans at two sites.
  • REC did not identify a potable supply well that is located within one-half mile of the contaminated source area.

  • REC did not notify the Inactive Hazardous Sites Branch within 24 hours of discovery that hazardous substances had migrated off site.
